HC stays nomination papers of 3 other BNP nominees

BD Correspondent: The High Court Division on Thursday gave no decisions in three writ petitions of former prime minister and BNP chairperson Khaleda Zia challenging cancellation of her nomination papers for two constituencies in Bogura and another in Feni.

As her lawyers expressed no-confidence on a junior justice holding the bench of 3rd judge to break the deadlock created after split decisions were given by a two judge bench.
The 3rd bench of Justice JBM Hassan said he would on December 17 give the decision whether her writs would be referred to the Chief Justice.

Khaleda’s senior counsel, former attorney general AJ Mohammad Ali expressed no-confidence on the bench of the junior judge saying under existing practice her writ petitions should be heard by a senior judge to break the deadlock.
Mohammad Ali requested the 3rd judge to send her matter to the Chief Justice.

The court told him that it could not send the matter to the Chief Justice unless he files a written objection.
As attorney general Mahbubey Alam gave objection to his no confidence Mohammad Ali submitted that the attorney general had no authority to represent the Election Commission since the EC had its own lawyers.

Mahbubey Alam showed an EX letter appointing him to oppose Khaleda’s writ petitions.
He requested Justice JBM Hassan to dispose of Khaleda’s matter after rejecting Mohammad Ali’s objection.
Later, Mahbubey Alam told reporters that Khaleda’s lawyers gave expressed no confidence on this court as they knew that this court would provide no remedy.

On Thursday, a bench of Justice JBM Hassan and Justice Khairul Alam rejected nomination papers of BNP nominees M Rashiduzzaman Millat for Jamalpur 1 constituency and Tahsina Rushdir Luna for the Sylhet 2 constituency, after staying the EC’s decisions allowing them to contest the poll.

On Wednesday the same bench rejected nomination papers of BNP nominee Afroza Khan Mita for Manikganj-2 after staying the EC’s decision allowing her nomination papers.
A bench of Justice Syed Refaat Ahmed and Justice Md Iqbal Kabir allowed BNP nominee Md Aslam Chowdhury to contest the election from Sitakunda, Chittagong 4 constituency and stayed the EC’s decision rejecting his nomination papers.
The Appellate Division set Monday for passing orders about the nomination papers of BNP nominees, Dhamrai upazilla parishad chairman Tomizuddin, Bogura district’s Shajahanpur upazilla parshad chairman Sarkar Badul and Bogura district’s Adamdighi upazila parishad chairman Abdul Muhit Talukder.
